Spribe Wins Temporary Malta Injunction
Spribe has secured a temporary injunction in Malta against three companies linked to Aviator Studio over alleged infringements of its EU trademarks. The order restricts the companies from using an identical brand and bars the use of the aviator.studio domain and other related domains.
The order applies to Aviator Studio Limited, Aviator Studio Holding Limited and Aviator Studio USA Limited, along with other companies covered by the ruling. They have been instructed to stop using signs that are similar to Spribe’s registered EU trademarks.
Spribe based its case on two separate trademarks it owns, including a figurative mark featuring the word “Aviator” alongside an image of an airplane.
The court also took into account how the games appeared in market listings. Searches for “Aviator” allowed users to see both games displayed at the same time on Betsson and EuroCasino.
The development follows Aviator Studio Limited receiving a B2B licence from the Malta Gaming Authority, allowing the company to distribute games in Malta and other EU markets.
David Natroshvili, founder at Spribe, commented:
“This is further momentum for Spribe after several positive outcomes. We expect a UK hearing in October and will continue to protect the Aviator game globally.”
The injunction remains temporary, and the companies involved have the option to appeal. Spribe is also required to commence proceedings leading to a decision on the merits within 31 calendar days of the order issued on 1 September.
