India Launches New Online Gaming Regulatory Framework
India has introduced a structured regulatory framework for its online gaming sector, with new rules taking effect on May 1, 2026, alongside the Promotion and Regulation of Online Gaming Act 2025. The system establishes clearer definitions, oversight mechanisms and a central authority to supervise the industry.
The Regulation of Online Gambling Rules 2026, published in April, formalises the distinction between online money games, e-sports and social gaming. This follows earlier legislative action in 2025 that restricted real-money online gambling activities across the country.
Under the updated framework, games will be assessed through a defined classification process. Online money games where users stake funds with the expectation of financial returns are prohibited. In contrast, social games and e-sports are permitted, provided they meet regulatory safeguards.
The classification process will be handled by the Online Gaming Authority of India, which will evaluate factors such as fee structures, reward systems, monetisation models and whether in-game assets can be converted into real-world value. Decisions are required within 90 days of a completed application.
The establishment of OGAI is a key element of the new regime. Operating under the Ministry of Electronics and Information Technology, the authority will oversee licensing, maintain a list of restricted games, issue regulatory guidance and handle appeals from users and operators. It will also coordinate with financial regulators to ensure compliance across the sector.
The framework builds on earlier concerns about the scale of online gambling activity in India, which led to stricter measures in 2025, including penalties for participation and promotion of prohibited games.
Registration requirements apply to selected categories of games identified by the government, including those posing higher risks to users or involving significant financial transactions. Approved providers will receive a digital licence valid for up to ten years, while online money games remain excluded from recognition as e-sports.
Operators must implement a range of consumer protection measures, including age verification, time limits, parental controls and in-app reporting tools. Details of these safeguards, along with complaint handling processes, must be disclosed during registration.
A two-tier grievance system has also been introduced. Users can first escalate complaints to operators, followed by appeals to OGAI and, if necessary, to the Ministry’s appellate authority. Each stage includes defined timelines for resolution.
The legislation also restricts financial institutions from processing payments linked to unlicensed gaming activity. This provision is expected to require coordination between regulators and payment systems, affecting transaction flows and withdrawal mechanisms.
Overall, the framework establishes a centralised approach to regulating India’s online gaming market, combining classification rules, compliance requirements and enforcement measures under a single system.
